303d list

The Agency has prepared a list of impaired waters to fulfill the requirements set forth in Section 303(d) of the federal Clean Water Act and the Water Quality Planning and Management regulation at 40 CFR Part 130. The report also provides information about the Total Maximum Daily Load program/process in Illinois.

2024

Illinois EPA (IEPA) submitted its 2024 Section 303(d) list to the U.S. EPA on October 2, 2024, with additional information submitted on October 30, 2024. U.S. EPA evaluated IEPA’s submission and determined that it was not fully consistent with the requirements of Section 303(d) of the CWA and the U.S. EPA’s implementing regulations. On December 11, 2024, U.S. EPA partially approved and partially disapproved IEPA’s 2024 303(d) list submission. Specifically, U.S. EPA approved IEPA’s listing of certain water quality limited segments (WQLS) and associated pollutants (Appendix 1). U.S. EPA disapproved IEPA’s decision not to list WQLS for total phosphorus, because IEPA’s submission did not demonstrate that it satisfied its obligation to assemble and evaluate all existing and readily available water quality-related data and information.

U.S. EPA has issued a public notice for public comment on its identification of 19 WQLS impaired by total phosphorus (Appendix 3) to be included on IEPA’s 2024 List of Impaired Waters under Section 303(d) of the Clean Water Act. The 45-day Public Comment Period starts December 17, 2024, and ends January 31, 2025. U.S. EPA will consider any comments received, make appropriate revisions based on the comments and transmit the final list of WQLS to Illinois.
