Technical Forms

Owners and operators who report UST releases to the Illinois Emergency Management Agency (IEMA) must meet the requirements of the Leaking Underground Storage Tank (Leaking UST) regulations. Once informed of the release by IEMA, the Illinois EPA's Leaking UST Section notifies the UST owner or operator in writing that he/she is required to comply with the Leaking UST Program requirements, including the submittal of applicable documentation on forms prescribed by the Illinois EPA and provided in the table below. Form requirements vary based on the regulation or statute that applies to the release. For instance, if the release is regulated under Part 732, look in that column to determine which forms are required. Every form listed is not required for every release; rather, the table lists all potential forms that may be required.

Regarding signature requirements on the forms, for owners and operators other than individuals, a duly authorized representative must sign on behalf of the owner or operator. For the following entities, the duly authorized representative must be one of the following persons:

  • For a corporation, a principal executive officer of at least the level of vice president, or a person authorized by a resolution of the board of directors to sign the applicable document if a copy of the resolution, certified as a true copy by the secretary of the corporation, is submitted with the document.
  • For a sole proprietorship, the sole proprietor.
  • For a partnership, a general partner.
  • For a municipality, state, federal, or other public agency, the head of the agency or a ranking elected official.
  • For a limited liability company, a member for a member-managed company and either a manager or a member for a manager-managed company.
  • For a land trust, a beneficiary of the land trust who meets the definition of “owner” or “operator” under 35 Ill. Adm. Code 731, 732, or 734.
