Model Memorandum of Understanding
The model Memorandum of Understanding (MOU) is used in cases where a unit of local government must enter into an MOU with the Illinois EPA before an ordinance can be used as an institutional control. An MOU is required when the ordinance does not expressly prohibit the unit of local government from installing and using potable water supply wells. The MOU submitted to the Illinois EPA must match the form and contain the same substance, except for variable elements, as the model in 35 Ill. Adm. Code 742.Appendix H.
The model MOU is provided only as a guide for persons using an MOU as an institutional control pursuant to 35 Ill. Adm. Code 742.1015(i). Use of the model document does not guarantee satisfaction of the requirements of 35 Ill. Adm. Code 742.1015(i) or approval of the MOU by the Illinois EPA. Each MOU submitted to the Illinois EPA will be reviewed and approved or disapproved based upon the applicable regulations and site-specific circumstances.
