Consumer Electronics Recycling Act

On August 25, 2017, Governor Rauner signed the Consumer Electronics Recycling Act (CERA), which modernizes many elements of the electronics recycling program in Illinois by establishing a convenience standard for electronics recycling which will ensure a minimum number of collection locations in each participating Illinois county. Although CERA took immediate effect, many of the programmatic elements of the law will not be implemented until January 1, 2019. In the interim, the collection obligations of the Electronic Products Recycling and Reuse Act (EPPRA) remain in effect. In addition, many of the reporting requirements in CERA will operate concurrently with the EPPRA reporting responsibilities, until EPPRA sunsets on January 1, 2020. The Illinois EPA has drafted fact sheets covering manufacturer and recycler responsibilities for stakeholder reference.

Under Section 1-20 of CERA any county, municipal joint action agency, or municipality (that contains a population of more than 1,000,000 residents) may elect to participate in the manufacturer e-waste program set forth in CERA by filing a written notice of election to participate with the manufacturer e-waste program and the Illinois EPA. The registration deadline for the program year beginning in January 2019 was March 1, 2018. Fifty-eight units of government filed elections to participate in the program beginning in January 2019. Below is a table reflecting each county, municipal joint action agency, and municipality that filed an election to participate in the program, the number of proposed collection sites included in each election, and the number of proposed one-day events included in each election.

The number and location of the collection sites is subject to change based on the allocation set forth in Section 1-15(a) of CERA and the collector registrations, which are due January 1, 2019. These elections do not impact any collations that occur or are scheduled to occur during calendar year 2018.

By July 1, 2018, the 2019 Manufacturer Program Plans are to be submitted to IL EPA, which will reflect the number of collection sites and one-day collection events in each county that are proposed to be included in the 2019 collection program.
